Terms and Conditions

The Company shall be named Premier Clothing trading as Wombat Clothing and the Buyer shall be the person ordering the goods. These Conditions shall apply to every order accepted by the company and no variation or obligation shall be effective unless given in writing by the Company and signed by a Director.

Orders are accepted on the understanding that if any conflict arises between the Company’s Conditions of Sale and any terms or conditions of the Buyer then the Company’s shall prevail in all cases. The placing of an order by the Buyer is deemed as acceptance of the Company’s Condition of Sale.

Prohibitions
You must not misuse this Website. Breaching this provision would constitute a criminal offence under the Computer Misuse Act 1990. Premier will report any such breach to the relevant law enforcement authorities and disclose your identity to them.

We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of this Website or to your downloading of any material posted on it, or on any website linked to it.

Password/account security
You are responsible for maintaining the confidentiality of your password and account and any activities that occur under your account. Premier shall not be liable to any person for any loss or damage which may arise as a result of any failure by you to protect your password or account.

Terms of Sale
By placing an order you are offering to purchase a product on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price. Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are limited to mainland UK and subject to any delays resulting from postal delays or force majeure for which we will not be responsible. Please see our Delivery Charges notice for further information. In order to contract with Premier you must be over 18 years of age and possess a valid credit or debit card issued by a bank acceptable to us or a valid cheque book and guarantee card. Premier retains the right to refuse any request made by you. If your order is accepted we will inform you by email. When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit, debit card or cheque and guarantee card used to place your order and that there are sufficient funds to cover the cost of the goods. All prices advertised are subject to such changes.

Our Contract
When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order: this email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us will not be formed until we send you confirmation by e-mail that the goods which you ordered have been dispatched to you. Only those goods listed in the confirmation e-mail sent at the time of dispatch will be included in the contract formed.

Pricing and Availability
Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund. All prices are inclusive of VAT. Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the 'Total Cost'. Whilst all possible effort has been taken to display garment colours accurately, we can not guarantee that your monitor’s display will accurately reflect this.

Payment
Upon receiving your order we carry out a standard pre-authorisation check on your payment card to ensure there are sufficient funds to fulfil the transaction. Goods will not be dispatched until this pre-authorisation check has been completed. Your card will be debited once the order has been accepted. Discount Codes (i) Account discount codes - Discount codes may from time to time be offered to account holders; such codes may only be applied to purchases made through the account and not, unless other wise offered passed onto third parties. (ii) Promotional discount codes - We may from time to time offer promotional discount codes which may apply in respect of any, or certain specified, purchases made though this Website. The conditions of use relating to any discount code will be specified at the time of issue. Returns policy There is no need to telephone us when sending us a return, however if you feel it necessary you can email admin@wombatclothing.com. Fill out the returns form enclosed with your order, noting whether you would like an exchange or refund.

Take your parcel to your nearest post office. We recommend that you send returns by recorded post. Always retain proof of postage. Goods are returned to Wombat at your own risk & expense.

We will contact you via email to confirm your return has been processed. You will receive your refund or exchange within 3 weeks after you post the goods back. Legal Statement
Returning any item within 1 month will be taken as notice of cancellation of your order (or relevant part of your order). Goods are provided to you on approval and legal title to the goods will not pass to you until the one month post-delivery period has expired. On receipt of the returned goods, Wombat will give you a full refund of the amount paid for the goods (but not the postage) or an exchange/credit as required. When returning goods on which you have received a discount/offer, that discount/offer will no longer apply if you fall below the discount/offer threshold and the refund will be adjusted accordingly. Your statutory rights on returns are considerably enhanced by this statement. All refunds are looked at on an individual basis. A full refund will only be given to goods in a resalable condition that are not marked for example by make up, in original packaging complete with all labels. Damaged or defective products If in the Buyers opinion the goods sold do not meet the required standard set for each garment then please do not hesitate to contact Premier detailing the problems with the item. All refunds will be looked at on an individual basis so please send with as much information as possible to ensure a swift response. When returning the goods please follow the returns procedure above. Please note that All items that have been worn / used regardless of the condition and the reason for the refund must be washed prior to returning. ANY garments not washed will be returned without a refund.

Suspension of site
We reserve the right to suspend the site at any time to perform essential maintenance, change details and to remove any inaccurate or unauthorised material, and also to terminate your use of the site if you breach any of these terms and conditions.

Change of site details
We reserve the right to change at any time any of the details of the garments on the site, including prices, colours and sizes.

Change of legal notices
We reserve the right to change these terms and conditions and we advise that you read through them each time that you use the site.

Jurisdiction of site
This website, its content and any contracts arisen out of it are governed by and in accordance with English law. All contracts are conducted in English and by entering into a contract both parties agree to submit to the sole jurisdiction of the courts of England and Wales.

 

Ethical Policies

1. Introduction
Premier strives to conduct business to the highest ethical and environmental standards seeking to use and utilise manufacturers that do the same. Premier has its own detailed code of conduct, which is integral to its business and that all suppliers and their sources must adhere to. Premier’s code of conduct is based on current best practices with regard to employment ethics, health and safety practices and environmental practices; so that when a customer purchases our goods they know that they have been produced under acceptable conditions. That means that the goods must have been produced:
  • lawfully, through fair and honest dealing;
  • without exploiting the people who made them;
  • in decent working conditions;
  • reducing the environmental impact during production and transportation.

Premier has the right to run audits and spot checks by themselves, or by external parties, on suppliers’ premises without prior their knowledge to verify that they are behaving in an appropriate manner.

2. Employment
All suppliers must meet the local laws on conditions such as minimum wages, hours of work, overtime and deductions. Or, where determinable the prevailing industry wage for the type of work involved. (International Labour Organisation (ILO) Conventions 1, 26, 95,131 and Recommendation 85).

3. Employing children
Premier does not condone the use of child labour and our suppliers must not employ children, other than under the ILO Convention 138 and Recommendation 146, which define a child as a person younger than 15 years old.

Premier does support legitimate, legally sanctioned apprentices and educated-related work as long as the child is not being exploited, there is no risk to the child’s health, education and development, and you have the permission of the child’s parents. (Article 32 of the United Nations Convention on the rights of the Child).

4. Forced labour
Forced labour, whether in the form of prison, bonded or uncompensated labour is not used. People are not forced to work for our suppliers by threatening them with a penalty. (ILO Conventions 29 and 105).

5. Disciplinary practices
Every employee must be treated with respect and dignity. No employee is treated with threatening behaviour, physical punishment or any form of mental or verbal abuse.

6. Non-Discrimination
Premier suppliers employ and deal with all their employees fairly and without discrimination. (ILO convention 111 and Recommendation 111). This is regardless of age, sex, race, religion or disability.

7. Freedom of association
Suppliers acknowledge that employees have the right to associate or unionise with any organisation that is legal in that country.

8. Health, safety and welfare
Premier’s suppliers all provide a safe place of work meeting all local laws relating to health, safety and welfare in the workplace. This means:
  • every effort is made to prevent accidents or injury:
  • health and safety procedures are implemented and employees are regularly trained and tested in what to do in certain situations;
  • there is always adequate lighting and ventilation;
  • clean drinking water is always available.

9. Environment
Premier is continuing to develop its environment practices in the production of the garments, the choice of fabrics used and the Premier working environment. Key examples of these procedures are:

9.1 Garment production
  • Premier is constantly working to minimise the waste fabric during production operations.
  • All companies comply with the EU general Product safety Directive 2001/95/EC.
  • Premier is working towards all suppliers complying with the requirements of the Azo dye directive and Nickel directives meaning that no Dangerous substances and Preparations are used during the make up of any of its garments

9.2 The Azo Dye Directive EU Directive 2002-61-EC, and subsequent amendments
This directive covers those Azo dyes, which are degradable to carcinogenic aryl amines, and is applicable to Textiles and Leather used in finished articles or their dyed parts, which may come into direct and prolonged contact with the human skin or oral cavity. National Laws implementing the new directive restrict azo-colourants (dyes) in textiles and l leather, replacing current restriction in Germany, Austria and the Netherlands. (The German and Austrian requirements for Azo-pigments will be retained, as they are not covered under this directive.) The requirements of the directive will be enforced by trading standards authorities, who will expect the retailer and supply chain to be able to demonstrate due diligence with respect to their enforcement of the requirements. Their expectations may extend beyond a paper trail, to a requirement for random spot checks on actual product.

9.3 Fabrics
  • A selection of the range now carries the FAIRTRADE mark. This is the only independent consumer label that guarantees a better deal for the producers in developing countries

9.4 Head Office recycling
  • Toner cartridges from laser printers are returned to the manufacturer for recycling.
  • All cardboard waste from the warehouse is recycled.
  • Premier is working towards all their plastic bags carrying recyclable logos.
  • Use of environmentally friendly office consumables where possible.
  • Collection point for office staff to recycle paper.
  • Email is our preferred method of communication to reduce the amount of paper used.
